Interstate Distributor Sued for Overtime

A suit, filed in the Superior Court of Pierce County claims, that a Tacoma based long haul trucking company has failed to pay drivers required overtime wages when driving over 40 hours per week.

Filed by Larry Westberry, a former driver, the suit claims that Interstate Distributor should pay its drivers 11/2 of their normal per mile rates when they drive over 40 hours per week. The suit is attempting to become class action on behalf of all drivers in a similar situation working for Interstate.

Interstate's senior V.P. of human resources, Renee Trueblood said Monday the company was just served with the suit.

Trueblood said, "This is still very new to us. We're still evaluating it."

Interstate Distributor employs 3,200 workers. Owned by the McLean family, it provides truckload services to Canada and the 48 lower states.

The suit claims Washington law interpreted in an 07 state Supreme Court requires drivers be paid overtime for time logged over 40 hours even if it is out of state.

The U.S. Supreme Court refused to consider the trucking industry's appeal of the state's ruling.

The suit was filed by Seattle firm Bendich, Stobaugh, & Strong on Westberry's behalf. The firm specializes in employment cases and has previously handled a suit against Microsoft on the behalf of temporary workers which resulted in a $97 million payout.
